塑身衣商標戰 瑪麗蓮涉侵權遭起訴

國內兩家知名塑身內衣品牌爆發商標法糾紛，「維娜斯」認為「瑪麗蓮」盜用公司「推推指」的商標創意所以提告。瑪麗蓮的專櫃與公司先前被搜索，相關廣告文宣遭到查扣，經檢方偵辦，台北地檢署今天將瑪麗蓮的負責人依照違反商標法罪嫌提起公訴。

起訴書指出，「瑪麗蓮」與「維娜斯」都有銷售高價女性調整型內衣，在塑身衣市場互為對手。民國98年8月間，維娜斯請到廣告才子范可欽替公司的內衣產品設計「推推指」圖樣，雙方簽訂廣告代理契約，並向智慧財產局申請商標註冊，隨後再找藝人小S、孫芸芸當廣告代言人。瑪麗蓮則因銷售競爭壓力，自民國99年底聘請名模隋棠代言內衣廣告，並將旗下塑身衣取名「V1彈力推推指」、「S1超纖推推指」，讓維娜斯質疑瑪麗蓮有意讓消費者產生混淆，涉嫌盜用商標創意所以提告。

雖然瑪麗蓮的呂姓負責人供稱，推推指在業界廣泛使用，如同動動手、跑跑步等常見修辭法，應不具識別性，也不知道已經申請註冊。但檢方調查後，認定負責人涉嫌違反商標法，因此將他提起公訴。
