酒後砍死老同事賠錢獲原諒　獲輕判10年半

【張欽／台北報導】新北市黃姓男子，今年2月間與老同事在桃園1家卡拉OK飲酒後，一夥人返回公司宿舍，不料，黃男反對與周姓老同事回鍋上班，雙方起口角大打出手，黃不滿被周打倒在地，憤而持番刀砍死周男，案發後賠償家屬280萬元和解，最高法院日前依殺人罪判黃男10年半徒刑，全案定讞。
 
住在新北市五股區的黃男，今年2月22日晚間7時許，與周男等昔日老同事在桃園縣蘆竹鄉西濱公路旁的檳榔攤附設卡拉OK飲酒，約1個小時後，黃男一夥人回到大園鄉砂石公司宿舍，而周男想回老東家上班，但黃男反對，2人一言不合大打出手。

黃男不甘被周男打倒在地，憤而到機車置物箱取出1把番刀，朝周男背部猛刺，致周男右肺、肝臟被刺破，經急救後仍不治死亡。一審法官認為黃下手猛烈，依殺人罪判黃男12年徒刑，但二審認為，黃男已賠死者家屬280萬元和解，改判10年半，最高法院日前駁回上訴後，全案定讞。
